  1. Please carefully read the following license agreement before opening the 
  2. CD wallet. By opening the CD wallet you accept the terms of this agreement.
  3. If you do not accept the terms of this agreement, do not open the CD wallet
  4. and promptly return the entire package to AZTECH for a full refund.
  5.  
  6. If you have opened the CD wallet before reading the printed license agreement
  7. and are now reading this agreement from one of the CD's in the package, and
  8. you disagree with any of the terms of this agreement, please immediately
  9. replace the CD in the wallet and return it to Aztech along with your original
  10. invoice or receipt for a full refund. In addition, immediately destroy all copies
  11. of the package or any of its components.

  13. You have ninety (90) days from the date of purchase to request a refund.
  14.  
  15. DEFINITIONS
  16.  
  17. The following definitions apply to the terms as they appear in this
  18. agreement:

  20. "AZTECH" means AZTECH NEW MEDIA CORP.
  21.  
  22. "You" and "Your" refer to any person or entity that acquires or uses this 
  23. package.
  24.  
  25. "Package" means the software, images, data, printed image catalogue of the 
  26. WorldBank Personal Image Bank, in whole or in part.
  27.  
  28. "Software" means the computer program contained in this package, together
  29. with all codes, techniques, software tools, formats, designs, concepts,
  30. methods, and ideas associated with the computer program. The term also
  31. includes all copies of any part of the software, the optical media and
  32. contents, as well as the manual(s) and other printed materials contained in
  33. this package.
  34.  
  35. "Image manipulation" means significantly altering, via software, any of the
  36. supplied digital images such that an image from the package that has been
  37. "manipulated" is no longer recognizable as having come from an original in 
  38. this package.
  39.

  41. COPYRIGHT / PROPRIETARY PROTECTION 
  42.  
  43. The software and package is wholly owned and copyrighted by AZTECH and is
  44. protected by United States and International copyright laws as well as other
  45. international trade provisions. You must treat the software like any other
  46. copyrighted material. The software involves valuable proprietary rights of
  47. AZTECH and others and has been developed with certain trade secrets. 
  48.  
  49. There is no transfer to you of any title to, or ownership of, the software
  50. or any patent, copyright, trade secret, trade name, trademark, and other
  51. proprietary rights related to the software, regardless of the form in which
  52. the original or other copies exist. You must not violate these rights and
  53. you must take appropriate steps to protect AZTECH rights. AZTECH may at any
  54. time replace, modify, alter, improve, enhance, or change the software
  55. without notice. Both the license and your right to use the software
  56. terminate automatically if copies of the software are made or if you return
  57. the complete package to AZTECH.

  60. PERMITTED USES
  61.  
  62. AZTECH grants you a single user, non-exclusive license to use the software
  63. in this package according to the terms as follows.You MAY:
  64.  
  65. Use the package for any purpose, whether for video display, print media or
  66. otherwise and whether for commercial or personal use, provided the primary
  67. value of the product is not the images themselves. For clarity, you may use
  68. the package for advertisements, brochures, newsletters, marketing literature,
  69. presentations, etc. 
  70.  
  71. Operate the software on only one computer at a time. 
  72.  
  73. Make one backup copy of the software, which automatically becomes the
  74. property of AZTECH and is subject to this agreement.
  75.  
  76. After written notification to AZTECH, transfer all (but no lesser portion)
  77. of the software to another person or entity who, in turn, is subject to this
  78. agreement.
  79.  
  80.  
  81. PROHIBITED USES
  82.  
  83. You may NOT:
  84.  
  85. Publish, sub-license, sell, re-sell, distribute, give away, lend, rent,
  86. lease or provide to others, in whole or in part, the package.
  87.  
  88. Use the package for any purpose where the primary value is the images 
  89. themselves. You are strongly encouraged to submit in writing to Aztech any 
  90. questions you may have regarding the interpretation of this license.
  91.  
  92. Copy or distribute copies of the software, documentation or the package to
  93. others.
  94.  
  95. Modify the software or merge it with another program, except for your
  96. personal use on a single computer and except for image manipulation as
  97. defined above.
  98.  
  99. Reverse-engineer, disassemble, decomply, or make any attempt to discover
  100. the source code to the software. 
  101.  
  102. Translate or create derivative works based on the software, except for
  103. image manipulation.
  104.  
  105. Remove, obscure, or alter any notice of the patent, copyright, or other
  106. proprietary rights related to the software.
  107.  
  108. Operate the software on more than one computer at a time. If you plan to
  109. operate the software on a network, please contact AZTECH to request a 
  110. Network License Agreement.
  111.  
  112. Transfer the software or any direct product to any person or entity in
  113. violation of the United States Export Administration Act.
  114.  
  115.  
  116. LIMITED WARRANTY
  117.  
  118. AZTECH warrants that, upon delivery by AZTECH of the CD's on which the
  119. software is distributed, the package will be free from defects of workmanship
  120. and that the software will substantially conform to the specifications
  121. established by AZTECH.
  122.  
  123. AZTECH does not warrant that the software is free from all bugs, errors,
  124. and omissions. This warranty gives you specific legal rights, and you may
  125. also have other rights that vary from state to state and country to country.
  126.  
  127. If any of the software fails to comply with the warranties set forth above,
  128. AZTECH's sole and only liability is to replace the package or portion
  129. thereof, or at AZTECH's option, make a reasonable effort to correct the
  130. program errors. You must however return all copies of the software, along
  131. with a copy of your paid invoice, to AZTECH within ninety (90) days of the
  132. date you purchased the software. If AZTECH is unable to correct the 
  133. defective CD or program error, AZTECH will refund all or a fair portion of
  134. the price you paid for the package, at AZTECH's option. The refund will
  135. fully satisfy your claims for software or disk failure. 
  136.  
  137. Any replacement software will be warranted for the rest of the original 90-
  138. day warranty period or for 30 days from the date you received the replacement,
  139. whichever is longer. 
  140.  
  141. Colors may vary from images displayed on a screen or a poster/catalogue, to
  142. that of final print. You must therefore make color proofs of the images
  143. prior to printing to assure yourself as to the color suitability in any
  144. product. Aztech accepts no liability of any kind for any consequence arising
  145. out of the usage of this package or the software contained herein. You agree
  146. that Aztech's maximum liability for any cause of any action of any kind is
  147. limited to the replacement value of a single package.
  148.  
  149. You should give proper credit for all images in this package to the
  150. respective photographer.
